| Court Counsel filed Spot Inspection report of Patnitop area | | DB dissatisfied with the CEO PDA reply, issued show cause notice | | Jammu, October, 03
In the much publicized Public Interest Litigation filed regarding Patnitop Development, the Division Bench comprising Chief Justice BA Khan and Justice Mansoor Ahmed Mir of J&K High Court Jammu Wing today shown its dissatisfaction over the reply of the Chief Executive Officer, Patnitop Development Authority Mr. KK Gupta, who was present in the Court, has issued show cause notice as to why the proceedings against him for disobedience of the Court order be not initiated.
This order has been passed when the Court Counsel Mr. DC Raina Sr. Advocate submitted his report regarding the on spot inspection of Patnitop area to verify the status of compliance shown by Chief Executive Officer, Patnitop Development Authority. In the inspection report Sr. Advocate DC Raina along with assisting Counsel Mr. Vikram Singh and two other persons had visited the Patnitop on June 21, 2006. After they have round the area through circular road, submitted that it was quite disturbing to see that a full fledge public meeting was going on in the Patnitop area by a political party, hundreds of people were present in the area to attend the said political gathering. The people had parked their vehicles in haphazard manner on the road-side, virtually jamming the entire area and bringing the traffic moment to a stand still. The loud-speakers were placed on the top making the entire environment of the area very noisy. Hardly any police officer, traffic cop or any official of the PDA was seen in the area, the littering was also apparent. The road condition was also not good and road condition of the area was very poor and required a considerable improvement. Though apparently there appeared to be some improvement regarding cleanliness of the area, but only one factor had completely spoiled the natural and climatic impact of the Patnitop area and that was the unmanaged road-side parking and holding of public meetings in the tourist area, making the calm atmosphere loudy and noisy, besides huge dumps of the garbage and plastic wastes were found in the forest area, thus disproving the claims of the authorities regarding the cleanliness of area.
In the inspection report Sr. Advocate DC Raina suggested for the improvements and cleanliness of the Patnitop area, which is an ideal place for tourists regarding road condition, Court counsel suggested for the improvement of damaged roads should be repaired immediately, road-side parking is required to be managed by the concerned authorities. Complete ban on holding of the public meetings in the Patnitop area and also ban on the use of loud-speakers in the Patnitop area. Regarding the sanitation, it was suggested that the sanitation of the area and enforcing the directions issued by the High Court regarding ban on use of plastic bags check on the mushroom growth of the Hotels, Huts and Guest Houses in the Patnitop area, which is also one of the contributing factors for growth of vehicular moment in the area, causing environmental pollution.
After considering the report filed by the Court Counsel, the DB in the open Court, which was jam-pack asked the CEO PDA about the meetings of political parties in the Patnitop area. Upon this Mr. KK Gupta CEO PDA shown his ignorance of the meeting and said that there is no necessary of his permission, upon this the DB took serious note and issued show cause notice. JNF |
