| HC summons Vigilance Commissioner | | | Early Times Report Jammu, Oct 27: In a petition filed by an employee of CADP seeking quashing FIR registered against him, Justice Sunil Hali of J&K High Court Jammu Wing today directed the Vigilance Commissioner to remain present in person on the next date of hearing. He has also been directed for filing status report on or before the next date of hearing indicating as to whether sanction has been accorded by the Government or not, in case sanction has been accorded, why the report u/s 173 Cr PC has not been filed before the Court of competent jurisdiction. This significant order has been passed in a petition in which Advocate Yasser Ejaz Tak appeared for the petitioner and senior Additional Advocate General SC Gupta appeared for the respondent state. Justice Hali, while directing Vigilance Commissioner, observed that in the status report filed by the respondent in pursuance to order May 14, 2008 passed by this Court it was reported that the investigation in the case has been completed and the case has been sent to the Government for grant of sanction. On April 30, 2009 this Court allowed two weeks time to then AAG for filling status report regarding grant of sanction, if any by the Government, compliance of the said order has not been done. Again on May 18, 2009 when the matter was taken-up, the then AAG was directed to report on next date of hearing as to whether sanction has been accorded by the Government or not, needful, however, has not been done. In these circumstances, Court directs Vigilance Commissioner that he shall remain present in person on next date of hearing. JNF
