Jammu, Oct 29: A Division Bench of J&K High Court Jammu Wing comprising Justice Virender Singh and Justice Mohd Yaqoob Mir extended interim bail of Purshtom Gupta and Nirmal Gupta Directors of Gopal Arya Mission Finance Company upto December 15, 2009.
DB after hearing Rajiv Kataria appearing for the appellants, AAG Gagan Basotra for the state and Adv SS Ahmed Joint Receiver observed that the instant application, the petitioners are seeking extension of bail to them, initial order was passed on February 12, 2009, granted interim bail which was extended up to October 30, 2009. Division Bench further observed that the petitioners after getting relief of bail had been rendering assistance to the Receiver who was earlier appointed but he refused to work as Receiver. This has been informed to this Court. Joint Receiver SS Ahmed admits this fact and stated that New Receiver has been appointed by the Court that is the reason that the petitioners were not called for rendering any assistance. Additional Advocate General Basotra also does not oppose the extension of bail preliminary on the ground that investigating agency does not required the custodial interrogation of the petitioners, upon this DB extended the interim bail of both the directors up to December 15, 2009.
Division Bench appointed a retired Principal District & Sessions Judge as Receiver with effect from November 1, 2009 and he is entitled to remuneration of Rs 20,000 + Rs 2000 as convince charges per month. JNF
