HC says no to CBI probe in Chopras murder case

Jammu, Oct 30: Justice Hakim Imtiyaz Hussain of J&K High Court Jammu Wing in a much publicized murder case of Chopra Family on September 18, 2006, declined investigation of the case by CBI and permitted SIT to submit the challan before the competent court without any further delay.
In a petition filed by Puneet Chopra son of deceased RB Chopra in which Advocate DS Thakur and Pranav Kohli appeared for the petitioner and submitted regarding handing over of investigation to the CBI and referred various facts emerging from the status report filed by the Special Investigation Team (SIT) and vehemently contends though the SIT has done some substantial progress but the SIT is not according to the counsel going in the right directions. There appear certain contradictions which have not been explained in the status report. Both the counsels have prayed for a fair, impartial and expeditious conduct of the investigation, the case be handed over to CBI and referred judgment of Punjab & Haryana High Court.
Sr. Additional Advocate General S C Gupta submitted that investigation of the case is almost complete now and SIT has prepared challan against the accused persons who are presently in custody. He seeks permission of the court to file the challan before the concerned court. CBI counsel Adv Navneet Dubey appeared for the CBI has vehemently opposed any move to handover investigation to CBI. He submitted that in case the investigation is entrusted to the CBI at this stage it is likely to further delay the matter.
Justice Hakim Imtiyaz Hussain after going through the case dairies and also perused the reports of the Narco Analysis Test (NAT) conducted on the accused and record produced by police would show that the case stands almost solved by the SIT. On April 25, 2008 the court considered the issue relating to handing over the investigation to CBI and found that the investigation of the case had reached at a most crucial stage and to hand over it some other agency like CBI was likely to adversely effect the progress of the case. Court, however, directed SIT to proceed with the case and expedite the investigation.
Ajab Singh Wazir son of Gurbaksh Singh r/o Trikuta Nagar (Business Associates of RB Chopra), Nigam Chopra son of B Chopra (Nephew of deceased RB Chopra), Mubaris Khan s/o Saleem Khan r/o Talab Khatikan and Suraj s/o Anarth Pradhi r/o Soura District Shiv Puri MP were put to polygraph, brain mapping and NAT at FSL Bangalore but their FSL reports are negative except that of Suraj whose test was positive who made certain material disclosure. After a hot pursuit of several months Bhawani Singh was forced to appear before SIT. He was taken to Bangalore for NAT where his role in the murder conspiracy came to light. The other accused of Gang were also put on polygraph, brain mapping and NAT at Bangalore on July 23, 2008 during which they made certain important disclosures on the basis of which the weapons of offence have been recovered by SIT during the raid and search from the houses of the accused persons. One of the arrested is also willing to become an approver and proceedings in this behalf have already been initiated.
