| HC dismissed petition against cultural assistants | | | Early Times Report Jammu, Oct, 31: Justice Mohammad Yaqoob Mir of J&K High Court Jammu Wing in a petition filed by Jagdish Singh challenging the selection of cultural assistants for district Kathua, has dismissed the petition with the observation that the petitioner after having actively participated in the selection process has not challenged the advertisement notice or the method of selection, until he could not find his selection, therefore, cannot now turn round to say that the process of selection was bad or the criteria adopted was irrational. Service Selection Board invited applications for two posts of cultural assistants for district Kathua. The Selection process culminated in the selection of two candidates namely Ajay Kumar and Reeta Rani who is not the party. The petitioner challenged the selection of Ajay Kumar on the ground that petitioner has done 10+2 and has done his Visharad & Bhaskar in music from Parcheen Kala Kendra Chandigarh and has also performed not only in the state but also outside the state and alleged that the selection committee has not acted fairly as they had not adopted a rationale criteria for selection. Justice Mohammad Yaqoob Mir after hearing battery of lawyers observed that grouse of the petitioner that he was more meritorious is totally misplaced. It is the Ajay Kumar who in the best wisdom of selection committed has been found to be meritorious among the mail candidates. The same position has been categorically made clear. The method and criteria for selection has been applied properly weight age for 10+2 as well as Additional points for participation have been awarded to the petitioner as both petitioners and respondent No 3 have only participated at Regional level so have been awarded five points each. The criteria applied totally rationale so is not opened to question. With these observations Court dismissed the petition. JNF
