| HC direct SFC for promotion of petitioners | | | Early Times Report Jammu, Nov 2: Justice Mohd Yaqoob Mir of J&K High Court Jammu wing directed J&K State Forest Corporation (SFC) consider case of petitioners for promotion of Junior Assistant on parity basis so as to avoid discrimination. This direction has been passed in a petition filed by Sunita Bhan and others who were engaged as daily wagers on May 30, 1988 in J&K State Forest Corporation, subsequently their services were regularized with effect from April 1, 1996. Similarly respondent figuring at serial No 40 in the tentative seniority list of helpers was adjusted as Junior Assistant, her adjustment has been challenged by one Subash Chander in which the High Court disposed of petition on May 6, 2008 with observation that seniority of Subash Chander is not disputed therefore private respondent could not be validly promoted as Junior Assistant. Finally direction has been issued that without disturbing the promotion of private respondent, same benefit shall be given to the Subash Chander. The petitioners Sunita Bhan and others also projected the similar ground that they being the senior, therefore, private respondent could not be adjusted as Junior Assistant over and above them. Justice Mohd Yaqoob Mir after considering the case of the petitioners and also gone through the judgment of Subash Chander Vs State of others, disposed petition on the identical terms that without disturbing the petition of private respondent petitioners too shall be considered for promotion as has been given to the private respondent. Respondent shall accord consideration to the case of the petitioners on parity basis so as to avoid discrimination. The exercise of according to considerations and to pass appropriate orders shall be completed within a period of six weeks. JNF
