| Choudharys seeking quashment of proclamation, HC issued notice to SIT, others | | | Early Times Report Jammu, Nov 4: In a petition seeking quashment of order passed by CJM Jammu on October 20, where a proclamation has been issued against Rakesh Kumar, Choudhary Nagar Singh alias Nago, Choudhary Jaggar Singh all are sons of Kola Ram, Justice Sunil Hali of J&K High Court Jammu Wing after hearing Sr. Adv M A Goni with Adv A H Bhat issued notice to State of J&K through Financial Commissioner Home, Ashok Gupta IGP Jammu Zone, Farooq Khan DIG Jammu-Kathua Range, Special Investigation Team under FIR No 247/2009 of P/S Gandhi Nagar Jammu through its Incharge Mubassir Latifi SP Incharge SIT, Rouf Lone DySP Member SIT and KP Singh Jasrotia DySP Member SIT and order to file objections in the above said petition. In the petition it has been submitted that the order dated October 20,passed by the Chief Judicial Magistrate Jammu on some unknown application and not on the application filed by the SIT through its Incharge as the same is absolutely wrong, illegal and against the provisions of law and further is violation of the constitutional and other legal rights of the petitioners besides being perverse and having been issued merely on the asking of the SIT so as to oblige the police and the same is not sustainable in law as such the petitioners challenged the same through the present petition and prayed for quashment and set-aside the order dated October 20, 2009 passed by the CJM Jammu where under a proclamation has been issued against the petitioners illegally and arbitrarily without following due procedures under law. Meanwhile bail applications of Choudhary brothers kept on board for tomorrow because the BAJ suspended the work for today due to the said demise of Adv Sanjay Sadhu. JNF
