| AMADEEP MURDER CASE | | HC issues notice in Nago family’s bank accounts | | Early Times Report Jammu, Nov 9: In a petition filed by Dr. Panna Manhas Choudhary wife of Jatinder Singh Choudhary alias Raja and daughter-in law of Choudhary Nagar Singh seeking directions for de-freezing of family’s bank accounts, sealed in Amandeep murder case, the High Court today issued notices to the government and the Special Investigation Team. The case was listed in the Court of Justice Nisar Ahmed Kakru. In the petition it has been submitted that the police officers arrested in the murder case of Amandeep Singh remained in the custody of SIT for 15 days but the SIT has failed to recover any incriminating material or elicit and such clue from these arrested police officers which could lend support to the lame story of the SIT that some money has been exchanged through some hands in lieu of alleged destruction of evidence or fudging of weapon of offence. Neither the alleged money has been recovered nor the alleged weapon of offence. Meanwhile, the counsel for the arrested police officers including the then SSP Jammu Manohar Singh concluded their arguments in the bail application in the court of Special Judge Anti Corruption today. Special Judge JR Kotwal who is hearing the bail application case directed SIT to argue on the case on November 10, 2009. In the objections filed by SIT in FIR No 275/2009 u/s 5(2) PC Act 2006 r/w section 161/165-A RPC it has been submitted that there is at strong case depicting payment of bribe to fudge the weapon of offence and ammunition of offence/ FSL label. The alleged bribe amount to the tune of Rs 3.10 lakhs was recovered from Sarwar Hussain Bukhari Ballistic Expert and Rs 40, 000 from constable Raj Singh who was attached to the FSL. In the objection it has been submitted that accused Choudhary Nagar Singh, Jagar Singh, Rakesh Kumar are absconding who have abetted the commission of fudging of weapon of offence after entering into conspiracy with the accused who had the control over the seized weapon of offence which was important piece of offence in murder case of Amandeep Singh. It is only after the arrest of Nagar Singh and his two brothers, the mode of payment of bribe and other facts would come up. The grant of bail at this stage would be disastrous to the investigation which could lead to spoiling of the whole evidence connected with the case. There is ample evidence about fudging of evidence to which the accused are instrumental. The statements of witnesses recorded in this behalf have already deposed before the Court of law about the tempering of collateral evidence. Any concession at this stage in shape of bail or otherwise would embolden the accused and they may indulge in such crime undeterred and unchecked in further and sought dismissal of the bail applications of the arrested police officers.
