| HC asks Govt to appoint SAC chief | | | Early Times Report Jammu, Nov 13- Justice Nisar Ahmed Kakru of J&K High Court Jammu Wing today directed the State to take steps for appointment of the chairperson of State Accountability Commission without any further delay, unless state contemplates winding up the commission. Legal impediment, if any, the state shall be at liberty to bring it the notice of the Court on the next date, Justice Kakru said. Court also clarified that no interim direction is possible for appointment of the members at this stage in view of the mandate of proviso. This direction was passed in a petition filed by one Iftikhar Khan Salaria in which Advocate AK Sawhney appeared. Justice Kakru observed that it transpires on a plain reading of proviso that the appointment of a member pre-supposes satisfaction of a Governor to the effect that such appointment is necessary or expedient in public interest but such satisfaction is not needed in respect of a Chairperson of the Commission, yet it is unmanned for last months together. Considering the matter in its right perspective, instead of putting the Chief Secretary on notice to explain the inaction, the Court held that it would be appropriate to direct the state to take steps for appointment of Chairperson without any further delay.
