Letter written to Chief Justice regarding grabbing of land acquired for houseless below poverty line families treated as PIL

Jammu, October, 04:- A letter written to Chief Justice of J&K High Court by a Social Organization Samajik Insaf Manch Kathua in which the said organization bring to the notice of Chief Justice Mr. BA Khan of J&K High Court that land acquired by the Rural Development Department for the Construction of Panchayat Ghar in Village Pathwal, Tehsil Hiranagar, District Kathua and land acquired by the Social Welfare Department in various villages of District Kathua for the allotment to rehabilitate the landless, houseless, below poverty line scheduled caste families of District Kathua have been grabbed by the influential persons.



In the letter it has been submitted that Panchayat land situated in Village Pathwal measuring 1 Kanal 1 Marla and land measuring about 13 Kanal purchased by the Social Welfare Dept for allotment to below poverty line scheduled caste families had been grabbed by the influential persons. The people raised a strong objection against the influential persons and also approached to the Tehsildar Hiranagar with a written application through the concerned Sarpanch requested for the vacation of said land.



In the letter it was further submitted that enquiry conducted by the Manch disclosed that most of land acquired by the Social Welfare Dept for the allotment to the down-trodden ladies and houseless Scheduled Caste families have been grabbed by the influential and well-earning persons in various villages in District Kathua and the administration is deliberately has slept over the issue. In the letter a communication of dated August 1, 2005 of the Social Welfare Officer Kathua addressed to the Additional Deputy Commissioner Kathua has been attached for perusal of the Court.



In the letter it has been prayed for eviction of the land illegally occupied by the alleged influential persons and allotted to the deserving families as the these land grabbers have enough influence in the political circles and in local administration that is by letter written by the local people and orders are passed on from one office to other but nothing happens on the ground and if the Govt administration cannot achieve the intended goal of allotment of land to the poor in 50 years despite public investment, how one can believe that Govt administration is awaken and has been delivering goods to the people who are paying for them.



Chief Justice Mr. BA Khan after considering the facts of the letter ordered that letter be treated as Public Interest Litigation.
