Employee died due snake-bite, family approached forum
Divisional Consumer Forum directed Insurance Company to pay Rs 1 lace

Jammu, October, 04:- Divisional Consumer Forum Jammu comprising its President Mr. SL Pandita and Member Mrs. Minu Sharma in a complaint filed by the mother and brothers of deceased one Krishan Lal, who was working as Nursing Orderly in BMO Office R S Pura died on July 5, 2000 due to snake-bite, the deceased obtained group insurance policy, has directed National Insurance Company Ltd through its manager to make payment of Rs one Lace to the mother of the deceased Bimla Devi within 60 days from today by depositing the amount before this forum, failing which interest @ 6% PA shall charged on the amount from January 2001.



According to the complaint that deceased being bachelor so his mother and two brothers filed this complaint before the forum in which it has been submitted that BMO community Health center R S Pura submitted that claim along with relevant documents to the Director Institutional Finance and Resources (Nodal Officer Group Insurance Scheme) has submitted the same to the Insurance Company but the Insurance Company has not settle the claim on the stand taken by it that complaint is time barred.



Judgment written by Mr. SL Pandita President Divisional Consumer Forum after hearing Advocate Ashok Bhan appearing for the complainants, Adv Sanjay K Dhar appearing for the Insurance Company and Adv MA Bhat appearing for the Nodal Officer and persuade the relevant record and also referred a judgment of J&K High Court Division Bench regarding the limitation, observed that viewed from all angels, facts and circumstances, the present case reflects deficiency of service on the part of insurer National Insurance Company for not having fulfilled its obligation to pay compensation to the legal heirs of the deceased employee for which it had received premium in advance from the Govt of J&K. with these observations DCF entitled complainant to litigation expenses Rs 1000/-.
