| CJM rejects bail application of accused involved in Hawala money | | | Early Times Report Jammu, Nov 18: Rejecting the bail application of Mohammed Hussain, who was arrested on October 26, 2009 along with Rs.2.40 lakh Hawala money, the Chief Judicial Magistrate Jammu YP Bourney observed that the investigation conducted so far lead to the uncovering of vital clues indicating the involvement of the accused/applicant in the offence as alleged by the police. Therefore, the allegations against the accused are well founded and the investigation is in crucial stage, the applicant does not deserve to be released on bail at this stage. The accusations are therefore, well founded and the offences effect the society at large, therefore applicant is not entitled to bail at this juncture and accordingly the bail application is dismissed. In the bail application the accused submitted that he is a businessman and running a Kiryana Shop at Village Bagla Tehsil and District Doda. On October 26, 2009 on his visit to Jammu he was carrying Rs 2. 40 lakh as his earnings from the sale proceeds for purchasing goods and the police arrested him from Trikuta Nagar and seized the cash and also harassed him on one pretext or the other linking him with terrorist which was factually wrong. Chief Prosecuting Officer Pawan Khajuria in his objections filed submitted that the application was involved in commission of offence punishable under sections 3, 17, 21 of Unlawful Activities Act. He was caught carrying Rs 2. 40 lakh Hawala money, which was to be handed over to LeT militant namely Mohammed Arif. FIR was registered and the investigating agency swung into action. The CPO further submitted that a consignment was received by the applicant from one Sameer Ahmed who has also been arrested in another case registered at P/S Natrona u/s 8/20 NDPS Act. The investigation is in progress and the investigating agency is in the process of scrutinizing the call details of the accused and other suspects and some vital links has been traced with them. CPO objected the bail application on the ground that investigation is crucial stage and there is sufficient material to show the involvement of the accused. JNF
