| Court takes serious notice against former Principal Secretary Law | | New incumbent directed to take necessary action to avoid stern action | | Early Times Report Jammu, Nov19- Justice Virender Singh of J&K High Court Jammu Wing took serious note against Principal Secretary Law AH Kochak for not appearing in the Court as the Court issued bail-able warrants on October 12, 2009 in a contempt petition filed by Raghbir Lal Kohli and observed that as per the office noting, the bailable warrants dispatched on October 19, 2009 have not been received back executed or otherwise. Additional Advocate General AH Qazi submitted that Kochak has since retired and in his place a new incumbent Ghulam Hassain Tantary has taken the charge as Commissioner/ Secretary of Law. Upon this, Advocate Navneet Dubey submitted that may be Ghulam Hassain Tantary has now joined in place of AH Kochak, it does not exonerate him of his liability for not implementing the judgment of this Court which was upheld by the Supreme Court. He further stated that he would however move a formal application for impleadment of new incumbent along with AH Kochak then Secretary Law which was allowed by the Court. AH Qazi, however, assured the Court that AH Kochak shall now be informed to cause his appearance on the next date, upon this Justice Virender said that had this assurance not been given by Qazi, Court would have straightway issued non-bailable warrants of arrest to secure the presence of Kochak then Law Secretary. Qazi also placed on record that a communication dated November 10, 2009 addressed to Finance Secretary by the legal remembrance of Law Department for taking immediate action in the matter apprising that a contempt petition is pending in this regard and further submitted that he would inform the concerned department within this week only to ensure that the judgment of this Court is complied with in letter and spirit without any further delay. Upon this Court said that it is expected of the new incumbent to take necessary action without wasting any time in order to avoid any stern action from the Court. JNF
