As per the direction of the High Court IG Crime was present in person in the Court and submitted that he would re-examine the evidence collected by Investigating Officer and take such further additional evidence also as may be required to come to a positive, as to whether or not the case was fit for production in the Court law. He sought four week’s last and final opportunity to file the report in the Court after thorough investigation of the matter.

In the petition it was submitted that the deceased Ghulam Mohammed Rather happened to be childhood friend and class fellow of present Union Health Minister Ghulam Nabi Azad. The petitioner alleged that Fiaz Mohammed and Mohammed Younis along with other private respondents under the guidance of Mohammed Sharief Niaz hatched a conspiracy to eliminate Rather who had political affiliation with the National Conference. The while episode was narrated to the then Chief Minister Azad by a delegation of people led by Faqir Mohammed who immediately asked IGP Crime and Railways to look into the matter seriously and not to spare any one whosoever influential he may be. Immediately thereafter Faqir Mohammed appeared before IG Crime & Railway and disclosed the names of the persons involved in the heinous crime.

The petitioner had sought investigation through CBI or a team of Crime Branch headed by an officer not below the rank of DIG. JNF
