| Charges framed against CMO for tampering date of birth | | | Early Times Report Jammu, Nov 24- Special Judge Anticorruption Jammu JR Kotwal today framed charges against Abdul Hamid, the then Chief Medical Officer Rajouri, who allegedly manipulated his date of birth March 27, 1949 instead of March 27, 1947 u/s 5(2) r/w section 5(1) (d) PC Act 2006, 420/468/471 RPC. After hearing Chief Prosecuting Officer Purshtom Sharma appearing for the VOJ and Advocate BR Gupta appearing for the accused, the Judge observed that the service bio date of the Gazatted staff said to have been prepared in the year 1983 by one Arjun Singh and signed by the accused himself while posted as Block Medical Officer Mendhar, would show that the actual date of birth of accused is March 27, 1949 and not March 27, 1947. There is sufficient material on record to show that the first page of the service book of the accused Abdul Hamid, where his date of birth is written as March 27, 1949 is in the handwriting of the accused himself. Material on record also shows that accused overstayed in Government service for 23 months. According to the prosecution the accused at the time of his retirement was posted as Chief Medical Officer Rajouri and was thus a public servant. His date of birth is March 27, 1947. It is alleged that he while abusing his official position, dishonestly and knowingly manipulated his date of birth in his service book which he had been keeping in his custody and wrote it as March 27, 1949 instead of March 27, 1947. As a he continued in Government service even after the date of his retirement as per his actual date of birth and overstayed for a period of 23 months till he was forcibly retired vide the Government order dated February 14, 2007. Thus he obtained undue pecuniary advantage and caused loss to the state exchequer to the tune of approximately Rs 8 lakhs. JNF
