Accused Jaggar Singh files application for medical check-up

Jammu, Nov 27-In an application filed for immediate medical check up and treatment of Jaggar Singh one of the accused allegedly involved in fudging evidence in the much publicized murder case of Amandeep Singh, the Chief Judicial Magistrate Jammu YP Bourney today directed Incharge Special Investigation Team for taking necessary action and file report.

Jaggar Singh in his application filed through Advocate Kishore Kumar has submitted that the accusations against the applicant are that he has committed offence punishable u/s 201, 120-B and 409 of Ranbir Panel Code. It was further submitted that the accused along with other two accused surrendered on November 17, 2009 and were remanded to police custody by the Court of CJM on November 21, 2009 and ever since the applicant continued to be in police custody. In terms of the aforesaid order the applicant was granted assistance of an advocate during the investigation, however, the said order was clarified by the Court on November 25, 2009. Consequently the appellant has been subjected to physical and mental torture in violation of the law declared by the Supreme Court of India in DK Basu’s Case.

It is further submitted that on November 25, 2009, the applicant was taken for his medical check-up by the police to Government Hospital Gandhi Nagar Jammu in the evening hours as the applicant is an aged person of 63 years of age and facing urination problem. On his examination by the doctors it was opined that the applicant had developed prostrate and had accumulated a large quantity of urine in his urinary bladder. The doctors instructed the police personnel to get the Jaggar Singh properly checked-up and treated by the doctors of GMC Jammu, The petitioner submitted that in spite of the doctor’s advice he was not taken to a Specialist and was facing difficulty in passing urine and prayed for directions to the respondents for his immediate medical treatment.
