NEW DELHI, NOV 29: The move to appoint High Court judges and Chief Justices is likely to pick up after Chief Justice of India, KG Balakrishnan, expressed his concern here two days ago in his Law Day address over staggering number of cases pending in courts all over the country as also continuing vacancies of judges at all levels.
The Union Law Ministry is likely to announce appointment of judges against vacancies in higher judiciary soon in the wake of the remarks made by the top most judge of the country on Friday evening here at Supreme Court lawns while addressing judges and lawyers on Law Day.
He said that there are five vacancies for Judges in the Supreme Court. Government sources say that in High Courts there were as many as 240 vacancies for judges and in lower courts at district level over 2,500 judges needed to be appointed.
The High Court of Jammu and Kashmir has four vacancies after the last appointment of Justice Hasnain Masoodi as additional judge. He was elevated from a District Judge to his present post. Now Government sources say that this could again be back to five since Justice Nisar Ahmad Kakru is like to be elevated to the post of Chief Justice in a High Court of a Southern State.
In his law day lecture Justice Balakrishnan noted that there were about 4 million cases pending in various High Courts spread across the country. As many cases as about five times of this were before lower courts. And over 50,000 cases were pending in Supreme Court.
This poses a daunting task before those responsible for the administration of justice in the country. Sources say that the huge backlog of cases is a result of delay in appointment of judges. And among other reasons for this was reported lack of infrastructure like court rooms and residences for judges and court staff. |
