| MO facing trial in smuggling heroine gets bail | | | Early Times Report Jammu, Nov 30- Granting bail to Sanjeev Mahajan the then Medical Officer facing trial for smuggling of seven kilogram of heroine, Justice JP Singh of J&K High Court Jammu Wing Court observed that keeping in view the long incarceration of the petitioner and the absence of any evidence against him till date, the petitioner is found entitled to his release on bail pending his further trial. The Court while allowing the bail application directed that the petitioner be released on bail on his furnishing personal bond and surety in the amount of Rs 10,000 to the satisfaction of the Trial Court. After hearing advocate Ajay Singh Kotwal appearing for the petitioner and Additional Advocate General Jagdish Parihar for the State and going through the case and bail application of the petitioner of the accused who was booked u/s 8/21/28/29 NDPS Act, the Court held that during the course of hearing of the petition the state counsel stated that no incriminating evidence has been brought on record by the prosecution against the petitioner during the trial hence he is granted bail. According to the case on November 5, 2006 accused Lal Chand was intercepted by the JK Riflemen near LOC police post Palanwalla Akhnoor and during search seven KG heroine was found in his possession. During the investigation he revealed that he is simply a carrier and had named the main persons i.e. Vivek Mahajan and Sanjeev Mahajan. The police raided the clinic at Pathankot and arrested Sanjeev Mahajan who was then posted Medical Officer in the Himachal Pradesh and was lodged in the District Jail Jammu as under trial. JNF
