| HC issues notice, stays impugned Govt order of June 1st, 09 | | | Early Times Report
Jammu, Dec 01- In a petition challenging the government order dated June 1, 2009 whereby private respondent Joint Director has been allowed to look after the work of State Project Director Sarva Shiksha Abhiyan, Justice Virender Singh of J&K High Court today issued notice to Commissioner/ Secretary School Education Department, Commissioner/ Secretary GAD and Khurshid Ahmed Reshi Incharge State Project Director Sarva Shiksha Abhiyan returnable within three weeks and stayed the operation of the impugned order till next date of hearing..
According to the Advocate Sudershan Sharma, petitioner Rajinder Kumar serving as Joint Director School Education Jammu and by virtue of Government order dated June 1, 2009 the respondent Commissioner/Secretary Education regularized the promotions of Joint Directors and equivalent in reference to the communication dated April 22, 2009 issued by J&K PSC. The petitioner has been confirmed with effect from February 1, 2008 figuring at serial No 1 in the Government order dated June 1, 2009. The petitioner is the senior most joint director whose services have been confirmed prior to the private respondent who also figured in the said order at serial N0 3 and has been confirmed as Joint Director with effect from April 1, 2008.
It was further submitted that by virtue of Government order June 1, 2009 the private respondent who was working as Joint Secretary Board of School Education was transferred as Joint Director in SSA with additional charge of State Project Director Sarva Shiksha Abhiyan till further orders. Being a senior, the petitioner challenged the same on the ground that the petitioner at this fag end of his service career has to serve under his junior which cannot be allowed and challenged the same seeking the quashment of order.
