| Court acquits five in jail break case | | | Jammu, Dec 03- Third Additional Sessions Judge Jammu RS Jain today acquitted five accused persons facing trial in much publicized high security Kot-Bhalwal Jail’s break case in the year 1994. After hearing Additional Public Prosecutor for the State and Advocate Yogesh Bakshi appearing for the accused persons, the Judge observed that looking into the testimonies of the witnesses it is clear that there is no evidence against the accused persons to show their involvement in the commission of offence with which they have been charged. The Court further observed that it would be a futile exercise to carry on with the case against the accused as the same is not going to end in their conviction. Looking into the material on record it is evident that prosecution has failed to prove the guilt of accused, as such, accused namely Khurshid Ahmed, Safullaha, Bilal Ahmed, Mohammed Shafi, and Abdul Qayoom are acquitted from the charges leveled against them. According to the case the accused, who were lodged in Central Jail Kot-Bhalwal Jammu, entered into criminal conspiracy to escape from the Jail and for that purpose dug an underground tunnel. On getting information about the plan to escape, the police on November 27, 1994 entered the jail wards whereupon the accused armed with weapons and stones, having a criminal object to commit murder, attacked the police party and grievously injured some police personnel and thereby prevented them from discharging their duty. A case u/s 120-B/147/148/149/224/353/332/336//307 RPC was registered and after completion of the investigation challan was presented in the Court of law. JNF
