Narcotic smuggler awarded 10 yrs RI, Rs one lakh fine

Ramban, Dec 04- The District Court today awarded 10 years rigorous imprisonment and Rs one lakh fine to narcotic smuggler who was arrested by Chanderkot police on March 11, 2007 while carrying nearly two kilogram of charas.
While awarding imprisonment to the accused Mohammed Shafi son of Abdul Gani Sheikh of Khobagh Principal Sessions Judge Ramban Bala Joyti, after hearing Public Prosecutor GN Manhas for the state and Advocate Tasaduq Hussain appearing for the accused, observed that charas weighing more than one kilogram. , which is the commercial quantity, stood proved against the accused and is thus convicted under Section 8/20 of the NDPS Act.. Section 20 (C) of the Act prescribes rigorous imprisonment for a term which shall not be less than ten years and fine of Rs One lakh for this kind of offence. Indeed there is no evidence that the convict is habitually engaged in this kind of offences and his antecedents are free from any such stigma, still the nature of offence committed by him does not call for any quantitatively less punishment than prescribed. No circumstances are made for giving benefit to the convict in terms of section 562 CrPC. The virus of drug peddling is menacingly engulfing the nation, particularly afflicting the younger generations of the country as a whole and our backward state in particular. This area is becoming boon for the narcotic peddlers due to the fact it serves as ‘gateway to Kashmir’ as well as ‘gateway from Kashmir’ for other parts of the state and finally to other parts of India, so because number of such cases are brewing everyday throwing a challenge to the police agency due to difficult terrenes, various impasse and insurmountable mountains that provide shelter to those who are deeply engaged in this kind of crime. The ends of justice will, however, be met with by awarding him prescribed punishment and accordingly awarded 10 years rigorous imprisonment and fine Rs one lakhs to the accused. In default of payment of fine, he shall further undergo simple imprisonment for one year. Court clarified that sentences will run one after the other. JNF
