| Nago, brothers sent to 11 judicial custody | | | Early Times Report Jammu, Dec 04- After completion of their 15 days police remand, the Nagar brothers were today granted judicial remand for a period of 11 days for destruction of evidence in the much publicized murder case of Amandeep Singh . Special Municipal Magistrate Jammu SS Bali today granted judicial remand for a period of 11 days to Choudhary Jagar Singh, Choudhary Nagar Singh and Rakesh Kumar. The accused persons have been produced in tight security in the Court by the Incharge SIT SP Mubaisr Latifi for remanding them to judicial custody for a period of 15 days. However, the Court after perusing the application filed by the SIT as well as case dairy granted 11days judicial remand to all the three accused who were arrested by the SIT on November 21, 2009 in FIR 247/2009 u/s 302/34,201/109,120-B/409 RPC r/w section 3/25 and 27 Arms Act. While granting judicial remand the Special Municipal Magistrate observed that in view of the nature of allegations ‘I found no good ground to reject the application. Accordingly the, application is allowed and accused persons are remanded to judicial custody for a period of 11 days. Accused persons have prayed that they be sent to central jail Kot-Bhalwal Jammu on the ground as there was threat perception at District Jail Jammu. Keeping in view the prayer made by the accused persons, they be lodged in central jail Kot-Bhalwal Jammu with the direction that during this period Superintendent Central Jail Kot-Bhalwal Jammu shall ensure that accused persons shall remain separate from the other accused persons lodged in the central jail Kot-Bhalwal Jammu in the FIR 247/2009 (Amandeep Murder case). It is worthwhile to mention here that Choudhary brothers were absconding from the date when the FIR was lodged in the much publicized murder case of Amandeep Singh son of former MLC and Advocate, present PDP Leader Deepinder Kour. The police filed an application before the Court for declaring them absconder u/s 87 Cr PC. On October 20, 2009 CJM declared them absconder and directed that within a period of 30 days they should surrender before the court of SIT. However, before the expiry of 30 days deadline, Choudhary brothers surrendered before the Court of Judicial Magistrate RS Pura. The said Court referred the Choudhary brothers to the Court of CJM from where they were sent to judicial custody. But SIT again filed an application before Principal Sessions Judge Jammu for transfer the remand of Choudhary brothers from judicial custody to police custody. On October 21, Principal Sessions Judge allowed the application of SIT for police custody of Choudhary Nagar Singh alias Nago, Jagar Singh and Rakesh Singh from judicial custody to police custody in a case FIR 247/2009 of P/S Gandhi Nagar Jammu and directed Superintendent District Jail Jammu to produce accused persons before CJM Jammu, who shall remand them to police custody for such period as he deems fit in the circumstances of the case. Court had also directed Special Investigation Team that after conclusion of investigation, additional Charge-sheet shall be produced before CJM Jammu, who shall deal with the same in accordance with the law. On the same day CJM Jammu granted seven days police remand which was extended twice and today Choudhary brothers were sent to judicial lockup. During the police custody of the Choudhary brothers, SIT claimed that they had recovered actual weapon of offence (Katta). |
