Retired Tehsildar, two others charged in 219 kanal prime land scam

Jammu, Dec 09- Special Judge Anticorruption Jammu JR Kotwal today framed corruption charges against then Tehsildar Shanti Saroop Gupta, Farooq Iqbal Qazi then Patwari Halqa Deeli Jammu and Baldev Singh alias Papa private person allegedly involved in allotment of 219 Kanals 1 Marla prime state land situated at Village Deeli.. After hearing Chief Prosecuting Officer Purshtom Sharma appearing for the Vigilance Organization, the Special Judge observed that on perusal of record of the case the court has found sufficient reason to presume that the accused Shanti Saroop Gupta then Tehsildar Jammu and accused Farooq Iqbal Qazi then Patwari Halqa Deeli have committed offences punishable u/s 5(2) r/w section 5(1) (d) PC Act 2006 BK and sections 420, 465, 468, 471 and 120-B RPC whereas accused Baldev Singh alias Papa son of Nanak Chand of Apna Vihar Kunjwani committed offences punishable under the same offences and held that there is prima-facie case against all the three alleged accused. Offence punishable u/s 467 RPC, however, is not made out because none of the documents involved in the alleged transaction falls in the category of documents provided under the said section, charges against the accused are framed and prosecution is directed to enter its evidence and produce prosecution witnesses on the next date of hearing

According to Vigilance organization Shanti Saroop Gupta, then Tehsildar Jammu and Farooq Iqbal Qazi, then Patwari Halqa Deeli, Jammu hatched a criminal conspiracy with Baldev Singh son of Nanak chand of Sai, Tehsil RS Pura, a real estate dealer, for grabbing a big chunk of state land measuring 219 Kanals 1 Marla having huge commercial value situated at village Deeli. In furtherance of said conspiracy then Tehsildar dishonestly and by misuse of official position relied upon false reports made by the alleged accused Patwari that the said land were in possession of seven displaced persons on whose behalf alleged accused Baldev Singh had initiated process for their allotment and the accused Tehsildar allotted the said land in favour of said persons unauthorizedly even though he was not competent to make such allotments. By misusing his official position attested mutation in the names of the said allottees of January 31, 2005 on the basis of report dated January 27, 2005 made by said Patwari. After the allotments made by then Tehsildar, alleged accused Baldev Singh, on the basis of powers of attorney obtained from the said allottees ,sold the allotted land to different persons as such the act of the then Tehsildar caused huge pecuniary advantage for accused Baldev Singh and loss to the state exchequer.
