| Court rejects bail applications of 3 HM Activist | | | Early Times Report Ramban, Dec 14- Principal Sessions Judge, Ramban, Bala Joyti today rejected the bail applications of Ayaz Ahmed, Mohammed Yousaf and Javid Ahmed Malik alleged to be the active members of the banned organization “Hizb-ul-Mujahideen”. After hearing Public Prosecutor G.N Manhas and Advocate AR Mushtaq appearing for the accused persons, the Principal Sessions Judge observed that Court has carefully gone through the entire record and it is clear from that punishment for raising fund for purposes of committing a terrorist act can be up to life imprisonment. The settled law regarding bail is that the Court may grant bail even in non-bailable offences provided the Court is of the opinion that the presence of the accused persons will be secured during trial and they will not temper with evidence or win over the witnesses. Gravity of charge and nature of evidence are other important considerations that weigh heavily at the time of granting bail in cases of serious nature. There is no gain denying the fact that the accused/applicants are allegedly involved in anti- national activities jeopardizing the security of the state and endangering lives of people of this state. “Liberty is for only those who care for the liberty and human rights of others”, the Court held and rejected all the three bail applications. According to police, after their arrests, investigating agency recovered Rs 1.20 lakh from their possession. This amount is alleged to have been delivered to the accused persons by one Ghulam Hussain Wagay of Dhamal Hanjipura, Kashmir, for further delivery to “HM Divisional Commander”, Mushtaq Ahmad Bhat of Gool area. The affidavit sworn in by the Investigating Officer further reveals that the above said amount was brought in the area with a view to engage young ones into militancy and for this purpose a confidential letter addressed to Divisional Commander of HM outfit, namely Mushtaq Bhat code name Abu Maqsood was also recovered from the possession of the accused persons. It was also divulged that investigation was almost complete but statutory sanction to prosecute accused persons was awaited. JNF
