| Man accused of attempting wife’s murder denied bail | | | Early Times Report Jammu, Dec15- Dismissing the bail application of Mohammed Bashir allegedly involved in attempting to commit murder of his wife, Chief Judicial Magistrate Jammu YP Bourney, observed that releasing the accused on bail would invariably provide him an opportunity to temper with the evidence of flee away from the justice. The manner and mode in which offences alleged to have been committed also disentitles him from the liberty of bail, the Court further observed. Earlier opposing the bail application on the ground that applicant is involved in heinous and bailable offence; Chief Prosecuting Officer Pawan Khajuria with Prosecuting Officer Pankaj Sethi submitted that there is sufficient evidence to establish the accusation prima-facie. The investigation is at primary stage and applicant has tried to kill his wife carrying eight months pregnancy also whose face and hands were burnt and is undergoing treatment in the hospital. The statement of victim is yet to be recorded u/s 164-A Cr PC as such applicant does not deserve the liberty of bail. CJM Jammu after perusing the case history observed that the alleged accused/applicant on November 30, 2009 at about 12:30 AM in the deep of night tried to burn his wife when she was fast asleep by sprinkling kerosene oil on her bed and setting it on fire and jumped out of the window by keeping the door bolted from inside. However, when the victim woke-up and raised alarm the accused along with the inhabitants reappeared on spot and tried to control the fire. The investigation conducted so far has revealed that involvement of applicant, however, victim is yet to be examined owing to her bad condition. The accusations against applicant are therefore well founded and he has attempted to do away with the two lives. The mode and manner in which offences alleged to have been committed disentitles him from the liberty of bail, with these observations Court dismissed the bail application. JNF
