| CJM Kathua rejects bail plea of rape accused | | | Kathua, Oct 07 : Chief Judicial Magistrate Kathua Virender Singh Bhaua has rejected bail application of Amin son of Bashir of Tendi, Tehsil Billawar, Distt Kathua who is facing investigation for allegedly committing rape of a minor girl. As per the prosecution story, the accused is alleged to have abducted the victim Pooja of Kathua on 12-9-2006 for the purpose of sexual intercourse. Following the abduction the police registered a FIR No 278/2006 u/s 376/366 RPC against the accused. It was claimed that the police of police station Kathua recovered the victim Pooja from Delhi where she was kept forcibly by the accused. The accused was arrested and the girl was restored back to her family after medical examination. After hearing the arguments of Chief Prosecuting Officer Ravinder Rao and Prosecuting Officer Ajay Sharma for the state, the CJM rejected the bail plea of the accused and observed that the accused committed sexual intercourse and raped the victim without her consent. It was further observed that the investigation is in progress and enlarging the accused on bail would create hurdles in the investigation and is against the public policy. |
