Ban in interest of security: SC told

NEW DELHI, DEC 15: The Supreme Court on Tuesday was told that the ban on the pre-paid mobile telephone connections in the trouble torn border State of Jammu and Kashmir was imposed in the interest of the security.

The Solicitor General of India (SGI) Gopal Subramaniam told the court that the decision to ban the pre-paid mobile telephone connection was warranted because of security reasons.

The apex court bench of the Chief Justice KG Balakrishnan, Justice JM Panchal and Justice BS Chauhan was also told that the Union Home Ministry would file a detailed reply to the petition challenging the ban by January 8, 2010 when the petition would come up for hearing before their lordships. The Solicitor General submitted that the Home Ministry had received the notice only recently.

The court agreed with the SGI plea to drop the Cabinet Secretary as one of the respondents as the Union Home Secretary and the Secretary, Department of Telecommunication, have already been made respondents.

Gopal Subramaniam was responding to the petition by J&K National Panthers Party leader Bhim Singh that had challenged the ban on the pre-paid mobile connection in the troubled State. He said that the ban order by the Home Ministry was draconian, arbitrary, and unconstitutional and an assault on the fundamental rights of the mobile phone users and detrimental to the interests of its vendors in the State.

Bhim Singh said that the ban orders have rendered thousands of people without livelihood who were selling these connections at the retail market.
