| Former SSP files fresh bail application | | HC lists case for Dec 22 | | Early Times Report Jammu, Dec 19- Principal Sessions Judge Jammu today directed the prosecution to file objections in the fresh bail application filed by the former SSP Jammu Manohar Singh and ordered that the case be listed again on December 22, 2009. The former SSP in his fresh bail application submitted that since the alleged co-accused Nagar Singh and ors have been arrested on their surrender before the concerned court and more so the SIT has claimed to have recovered the weapon of offence allegedly used in the commission of alleged crime (murder of Amandeep), the applicant is entitled to file fresh bail application. In the bail application it has been submitted that as the alleged weapon of offence has been recovered and the alleged co-accused have been arrested, the offence u/s 409 RPC and in fact all offences against the applicant have now become only an attempt covered by section 511 RPC. In law allegation against the applicant would only be an attempt to commit an offence, the gravity of the charge and the offences alleged thus has radically changed and prayed for grant of bail.
