| HC issues notice to Com/Secy Health, Principal GMC in contempt case | | | Early Times Report Jammu, Dec 22- In a contempt petition filed by Kunal Sharma and Ors for not allowing them for doing internship in GMC Jammu despite the Court direction on November 11, 2009, Justice JP Singh of J&K High Court, after hearing Advocate SS Ahmed, issued notice to Atul Dulloo, Commissioner/Secretary Health and Medical Education Department and Dr. Rajinder Singh Principal GMC Jammu for filling statements of facts and directed to list the case on December 29, 2009. In the contempt petition it has been alleged that petitioners filed a writ petition titled Rishab Bhan and Ors in the state High Court seeking quashment of the Government order dated May 5, 2009 to the extent that petitioners being MBBS Graduates from ASCOMS Sidhra Jammu have been held not entitled to any stipend in the terms of Government order dated July 23, 2007 for undergoing one year compulsorily rotator internship in GMC Jammu merely on the plea of having not been selected by Board of Professional Entrance Examination (BOPEE). The petitioners being the student of ASCOMS Jammu have been directed to furnish an undertaking illegally/arbitrarily that they will not stake any claim for the stipend for doing internship in the GMC Jammu/Srinagar. State High Court on November 11, 2009 directed respondents to permit the petitioners to undergo internship in the GMC Jammu till objections are filed. The petitioners in their petition submitted that they appeared before Principal GMC but were not allowed to join as they were verbally told that unless their institute ASCOMS do not deposit Rs 50,000 as security deposit and Rs 5000 of each student, the petitioners will not be allowed to join GMC Jammu and further the petitioners were told to file an undertaking/affidavit duly attested by Magistrate that the petitioners will not claim stipend while undertaking internship. The petitioners pleaded that the respondents willfully and intentionally did not implement the High Court order passed on November 11, 2009 for which appropriate action, as warranted under law, is required to be taken against respondents and issuance of Rule Nisi against the respondents and dealing appropriately against them.
