| 2009 will be remembered for criticism of judicial system | | | Agencies New Delhi, Dec 25: The year 2009 will be remembered more for severe criticism the judicial system in the country faced than for landmark judicial verdicts. Indian judiciary faced a lot of criticism from all important quarters for reluctance of judges to make their assets public and later collegium system of appointments of judges of the Supreme Court and High Courts also came under fire from the legal fraternity and public. Controversy cropped up following allegations of land grabbing and corruption against Karnataka High Court Chief Justice P D Dinakaran coming to light following recommendation of his name for elevation to the Supreme Court by the Supreme Court Collegium headed by Chief Justice of India K G Balakrishnan along with four others on August 27 this year. Ultimately, the name of Justice Dinakaran had to be kept in abeyance when the Union government rejected his name and sent his file back to SC Collegium for reconsideration The latest incident relates to the Union government again requesting SC Collegium to reconsider the name of Allahabad High Court Chief Justice Chandramouli Prasad for elevation to the Supreme Court in view of some representations having been made against him doubting his personal integrity. The name of Justice Prasad was also recommended by the SC Collegium for elevation to the Supreme Court along with Justice Swantatar Kumar, Chief Justice of Bombay High Court. Earlier, the CJI had recommended to Prime Minister Manmohan Singh to remove Calcutta High Court judge Justice Soumitra Sen through impeachment for not taking voluntary retirement following three-judges committee finding him guilty of misappropriation of funds of SAIL when as a lawyer he was appointed a receiver in a dispute between SAIL and Shipping Corporation of India, though the judge paid the money later. Both Justice Dinakaran and Justice Sen have stopped discharging judicial duties and are facing impeachment proceedings which have been initiated against them by Rajya Sabha Chairman Mohammad Hamid Ansari following representations made by opposition MPs from the Upper House. The former DGP, Haryana, SPS Rathore who had molested a teenager Ruchika Girhotra and later forced the small girl of 14 years of age to take the extreme step of taking own her life when torture and harassment meted out to her and her family members at the instance of the ex-DGP became unbearable, was let off with ridiculous punishment of sentence of six months. To add insult to injury, Rathore was immediately released on bail without spending even a day behind bars. Xxxxxxxxxxxxxx
