DB extends two weeks time on closure of Banquet halls

Jammu, Dec 30- Division Bench of J&K High Court comprising Justice Hakim Imtiyaz Hussain and Justice Ghulam Hasnain Masoodi today extended two weeks time for furnishing details in respect of banquet halls operating in the city while it granted six weeks extension in time in respect of Kamla Palace Banquet Hall for processing its case.
In a public interest case filed Puran Chand and Ors through Advocate SK Anand challenging the operation of Banquet Halls in the Municipal area, on May 7, 2009 Division Bench had ordered that banquet halls which are running within municipal limits, Jammu, without proper permission from the Municipal Corporation Jammu shall remain closed. Those banquet halls which have obtained proper permission shall be allowed to run subject to the condition that the music systems, if any, shall be operated from 10:00 AM to 10:00 PM only. Again the Division Bench on May 22, 2009 modified its order dated May 7, 2009 and allowed these banquet halls till December 31, 2009 and after the expiry of said date the earlier interim direction will automatically be revived, the Court had ordered.
In CMP filed by Kamla Palace Banquet Hall, the DB had issued notice which was accepted by Advocate Sham Sunder Nanda on behalf of Jammu Municipal Corporation. The DB had directed for filling reply by next date and also status report within six weeks, indicating the names of Banquet Halls who had applied for proper permission in compliance of court direction dated May 22, 2009 and present status of their cases. Upon this Advocate Nanda informed the Court that applicant Kamla Palace has already applied for permission as required under the direction of the Court and his case is under process.
It is worthwhile to mention here that on May 21, 2009 JMC filed status report as per the direction of High Court. The status report was submitted by Advocate Shyam Sunder Nanda appearing for the JMC. In the status report it has been submitted that 89 banquet halls working in the jurisdiction of JMC, in which four banquet halls namely Chander Bhaga community hall Baghwati Nagar, Jambolachan Community Hall at Mohalla Ustad and Ambedkar Community Hall at Resham Ghar Colony were declared authorized whereas 36 banquet halls were constructed prior to inclusion of the area in JMC. Besides four community halls owned by JMC and JDA the other 85 private banquet halls were declared unauthorized.
In the status report various halls located in different localities including Mahajan Bardari Bhawan Sabzi Mandi, Jain Bhawan Kali Jani, Khoranna Birdari Raj Tilak Road Jammu, Raj Pual Bhawan Amar Kashtriya Rajput Sabha meeting hall, Sher-e-Kashmir Bhawan Id-Gah Road NC Party Office, Brahaman Sabha, Dogra Saddar Sabha, Jain Bhawan Rani Park, Mahajan Hall Shalimar, Baba Balak Nath Digiana Rani Talab Temple Committee, Durga Palace Rampura Shastri Nagar Temple Committee, Janj Ghar Geeta Mandir Roulki Bakshi Nagar Jammu, Dewan Janj Ghar Sarwal Colony, Samriti Gurah Bakshi Nagar, all 14 religious halls were declared unauthorized.
According to the status report 11 hotels using as banquet halls declared unauthorized included Regal and Crystal Banquet Hall Hotel Asia, Nishat Banquet Hall Hotel Jehlum Resort, Mangal Varsha Banquet Hall Hotel TRG, Banquet Hall Karanti Hotel, Pealrs and Jewel Crown Banquet Hall Hotel Ritz Manor at Channi Thanger, New Karan Hotel Bakshi Nagar Jammu, Royal Treats Hotel Hari Niwas at Manda, Nandni Resort Hotel Ashok at Manda, Banquet at KC Residency, Banquet at Hotel Fortune Reveria, Banquet at hotel Premier Residency Road, were constructed before the inclusion of area into JMC.
