Murder of Rather, childhood friend of Azad, established
IG Crime files Investigation Report in HC

Jammu, Dec 30- In much publicized murder case of Ghulam Rasool Rather, the childhood friend of former Chief Minister and Union Minister for Health and Family Welfare, Ghulam Nabi Azad, the Inspector General of Police Crimes, Jammu today produced interim report in High Court indicating existence of prima facie evidence against the accused committing murder of Ghulam Mohammed Rather.
Following submission of the report, Justice J P Singh of Jammu and Kashmir High Court observed that Court does not see any justification in continuance of the interim order restraining the Investigating Police Officer to take further proceedings in the case. The Court further ordered that interim order passed on July 10, 2009 is accordingly lifted leaving the Investigating Police Officer free to produce the challan in the competent court of jurisdiction and list the case for consideration after vacation.
Following court directions of November 20, 2009, the IG took up further investigation in the case titled Ghulam Rasool Rather v/s Joginder Kaul. During the course of investigation various persons acquainted directly or indirectly with the case were examined and it surfaced that the accused persons had developed an ill motive against the deceased as he had been responsible in getting a work order cancelled. Further it was also established that on the fateful date before incident some of the accused persons were seen moving towards the place of incident and had enquired about the whereabouts of the deceased persons. There is material on the file that the deceased had not met with an unnatural death but it was a homicidal death. The IG further revealed in his investigation report the condition of the body of the deceased after the death rules out the story of fall as in that case the body would have been in a bad shape keeping in view the height from the place of incident and the place of recovery. The two eye witnesses who have witnessed the occurrence have unequivocally pointed out the role of the each accused persons in causing the death of the deceased.
In view of the evidence on the file which establishes the commission of offence u/s 302, 341, 104 RPC,the accused are found prima facie involved in the commission of offence, the IG said in his investigation report and prayed that permission be accorded to present the charge sheet before the competent court of law.
