| Soz’s stand on Art 370 ridiculous, says Gupta | | ‘Temporary’ Article misused to blackmail Centre | | Early Times Report
Jammu, Jan 01- Asserting that Article 370 of the Indian Constitution, granting separate status to Jammu and Kashmir, is most pernicious and against the interest of the unity of the country as also that of the people of this State itself, the leader of the BJP Legislators Party, Prof. Chaman Lal Gupta has questioned the statement of the Pradesh Congress Chief, Prof. Saif-ud-Din Soz that this Article cannot be abrogated as the Constituent Assembly which enacted this provision did not exist now and for having change, a new Constituent Assembly would have to be framed. Questioning the wisdom of the PCC leader, Prof Gupta observed that nothing can be more ridiculous than this claim of any right thinking person. He pointed out that since the coming into being the Constitution there have been about 100 amendments and being member of the Parliament, Prof. Soz himself had been there when some of these Amendments took place. In the case of Article 370, the issue of its abrogation should not be difficult because this provision has been inserted as “Temporary” one but it was a different matter that the polity of the country, more so, of the Congress had always been guided under communal considerations. The BJP leader said that this provision has caused more harm than any good over the years and added that it was unfortunate that those claiming to be secular their mindset have not changed. He asked the votaries of the separate status for Jammu and Kashmir that they should explain that what the people have gained out of the separate status except misleading Kashmiris by raising communal and other secessionist slogans. He maintained that despite receiving huge funds from the Centre, the State is still faced with so many problems including that of unemployment but for separate status which is the biggest hurdle in the industrial growth without which this problem is going to persist. This provision provided opportunity to the ruling leaders to blackmail the Centre by raising controversial slogans, in addition to fiddling with the democratic process and deprive the people of their basic democratic rights. The foul play in the electoral process and making a mockery of the local bodies as also that of Panchayati Raj are the glaring examples in this regard, he pointed out. The problems of refugees and those of the migrants could not be solved because of the separate status and the existence of Article 370, which must go in the interest of the people and that of the unity of the country, he added.
