| Three facing trial in custodial death granted bail | | | Early Times Report Jammu, Jan 07- In a bail application filed by Nazir Ahmed Wani, Mohammed Ashraf and Mohammed Rafiq Naik, who are facing trial in a custodial death of one Ayaz Ahmed Wani who died on November 10, 1995, Justice Sunil Hali of Jammu and Kashmir High Court today granted bail for a period of six months subject to furnishing of bail bonds to the tune of Rs 25000 each with one surety each of the like amount to the satisfaction of Sessions Judge Ramban. After hearing senior Advocate Sunil Sethi with Advocate Ravi Dogra appearing for the applicants as Deputy Advocate General BR Chandan appearing for the state, Justice Hali observed that it is admitted fact that the role of the present petitioners in inflicting injuries on the deceased or torturing him has not been proved by any legal evidence. Prosecution seems to be building the case against the petitioner only the on the basis of their background. It is nowhere revealed as to what role has been played by the petitioners who admittedly are not of the officials of the police and could not be said to be involved in the interrogation of the deceased or the investigation of the case. While enlarging the accused on bail for a period of six months the Court directed that the petitioners shall not leave the jurisdiction of Sessions Judge Ramban without prior permission from the said Court and they shall not temper with the evidence or influence the witnesses in any manner.
