| Permit petitioners to appear in Assistant Surgeon’s interview: HC to PSC | | | Early Times Report Jammu, Jan11- In three petitions seeking directions to the Public Service Commission to permit the petitioners for interview of Assistant Surgeons, the Vacation Judge of J&K High Court Jammu Wing Justice JP Singh today issued notice to State of J&K through Chief Secretary, Commissioner/Secretary Medial Education Health & Family Welfare and Public Service Commission through its chairman and secretary returnable within one week. The Court also directed the PSC to conduct interview of the petitioners for the posts of Assistant Surgeons. However, their results shall not be declared until further orders from the Court, Justice Singh directed. The petitioners submitted that a common screening test was held in 2008 and the result was declared on November 10, 2009 in which marks obtained by all the 2175 candidates were displayed. The PSC after declaring different cut-out points of candidates of three notifications approximately 85.92 and 87 respectively which is contrary to all cannons of justice and common practices. 1011 candidates were short listed for 468 posts of Assistant Surgeons which came to about 2 quarter of short-listing of respondent PSC prescribes short-listing @ 3 to 10 per post. But the Supreme Court has held that short-listing @ 3-5 per vacancy is valid as such no short listing was required and all the candidates are entitled to compete for all 468 vacant posts. The short listing is contrary to rules and law laid down by Supreme Court and thus the fundamental rights of petitioners to compete for the posts being infringed by the device of lesser short-listing and other device, Advocate BL Kalgotra said.
