| RS election challenged | | HC asks Soz to cough up Rs 2000 | | Early Times Report
Jammu, Jan16- In an election petition filed by JKNPP MLA challenging the notification issued by the Election Commission of India dated January 12, 2009 regarding election of Rajya Sabha, Justice Sunil Hali of Jammu and Kashmir High Court today set aside the ex- parte order dated August 21, 2009 and allowed the application filed by PCC President Prof Saif ud-Din Soz by condoning the delay subject to payment of Rs, 2,000 as cost.
Earlier, the High Court had issued notice to the Retuning Officer for the election of Rajya Sabha 2009, Election Commission of India, Union of India, Saif-ud-Din Soz, Mohammed Shafi MPs, Ghulam Nabi Azad and Dr. Farooq Abdullah Union Ministers and Chairman Rajya Sabha New-Delhi.
Disposing off the CMP, Justice Hali allowed Soz’ application and set aside the ex-parte orders. The Court also condoned the delay in filing application by Prof Soz subject to payment of Rs.2000 as cost to be paid to the counsel for the petitioner.
With regard to another CPM, Advocate Ajay Singh Kotwal representing senior Advocate MA Goni, appearing for Dr. Farooq Abdullah presently Union Minister and Mohammed Shafi Uri, stated that he will file an application for setting-aside ex-parte proceedings against Dr. Farooq and Shafi Uri. Court granted time for doing the needful and directed that respondents shall file reply within a period of four weeks and ordered to list the case immediately after vacations. JNF |
