Aanchal’s change of heart will not affect Rajneesh’s custodial death case in SC

NEW DELHI, JAN 17: The Rajneesh Sharma custody death case before the Supreme Court is not going to be affected by the latest turn of events because of his wife Amina Yusuf alias Aanchal Sharma’s leaving her in laws Jammu house in the wee hours of Friday morning for her parents abode in Srinagar since late Rajneesh’s mother and brother are also petitioners besides Aanchal in the case.
Saying this, the petitioners’ lawyer Pinki Anand told Early Times here today that she received a telephone call from Jammu and Kashmir to tell her that Aanchal had “resiled” from her earlier stand taken in the petition moved through Anand. “Yet this is not going to affect the custodial death case which is slated to come up for hearing on January 25 by the Supreme Court,” said the lawyer.
The lady’s or Aanchal’s change of heart would not affect the case in any manner because it was based on the fact that Rajneesh Sharma was picked up from Jammu by police and died in police custody in October last year twice warranting postmortem on the body to establish the cause of his death, said the counsel.
Earlier, Central and Jammu and Kashmir Governments were issued notice by a two-judge bench of Justice Altamas Kabir and Justice Cyriac Joseph of Supreme Court to be replied in four weeks time as to why the case regarding custody death of Rajneesh not be transferred to a court outside Jammu and Kashmir as the petitioners said that they had grave apprehensions regarding a fair probe and trial by the State Police and local courts. They demanded a probe by the CBI in the case.
The Supreme Court had also ordered Delhi Police Commissioner to ensure safety of Aanchal till she was in Delhi. She had got married in August last year in Jammu to Rajneesh Sharma when she changed her name from Amina to Aanchal.
Soon the two had left Jammu and Kashmir. And in the last days of September 2009 Rajneesh was arrested by Srinagar Police. In a few days time he succumbed inside police station giving apprehensions about honour killing through the help of the police. Besides Rajneesh family members his wife too had made same allegations against the police and also against her father and brother.
