| | | HC stays posting of TSO and Storekeeper CAPD Doda

Jammu and Kashmir High Court Jammu Wing today stayed the posting of Tehsil Supply Officer (TSO) and storekeeper Consumer Affairs and Public Distribution (CAPD) Doda.
In a petition challenging the Government order January 15, 2010 wherein it directed transfer and posting of Akhter Hussain as Incharge TSO Doda and petitioner as Store-Keeper Bhagwa on the ground that substantively appointed as Junior Assistant, Akhter Hussain could not have been adjusted and posted on a post two steps higher than the one held by him.
The Petitioner’s further plea was that the impugned Government order has the effect of putting the petitioner under the administrative control of respondent Akhter Hussain who is admittedly much junior to him.
Vacation Judge of J&K High Court Jammu Wing Justice JP Singh today after hearing Advocate B S Salathia appearing for the petitioners and documents placed on records prima-facie support the petitioner’s plea, issued notice to the respondents and in the meanwhile operation of Government order number 02-CAPD of 2010 dated January 15, 2010 in so far as its pertains to the adjustment and posting of Akhter Hussain as TSO Doda and petitioner’s posting as storekeeper Bhagwa is stayed and directed the registry to list the petition in the second week of February 2010.
