| Selection process of 468 Assistant Surgeons | | HC directs PSC not to finalize and publish select list | | Early Times Report Jammu, Jan 20 In a significant judgment, Jammu and Kashmir High Court, Jammu Wing today directed Public Service Commission not to finalise and published the list of selected candidates for the post of Assistant Surgeons for a period of four weeks Vacation Judge of J&K High Court Jammu Wing Justice JP Singh restrained PSC from finalizing and publishing the selection list for four weeks. The judgement made in a petition filed by Mir Yasir and other challenging the selection process initiated by Jammu & Kashmir Public Service Commission for selection of Assistant Surgeons in the Health & Medical Education Department as the 468 posts was advertised. During the course of arguments Advocate Abhinav Sharma submitted that the short listing of 562 candidates against 468 notified vacancies of Assistant Surgeons was impermissible, even according to the rules framed by the commission, requiring consideration of minimum three candidates against one post, which, if applied, would have allowed opportunity not less than 1404 applications to seek consideration for the selection. Justice J P Singh while issuing direction to PSC observed that on facts pleaded a prima-facie case has been made out to consider the issue raised by the petitioner’s counsel as to whether the criteria adopted by the J&K PSC was in terms of its notification and even otherwise permissible. Issue notice to the respondents, Advocate FA Natnoo accepted notice for the PSC; he may file objections by the next date. In the meanwhile the Jammu & Kashmir Public Service Commission directed to not finalize and publish the list of selected candidates for the posts of Assistants Surgeons and directed the Registry list the petition for consideration in the second week of February, 2010.
