| Govt’s fresh ‘dictate’ on transfer policy Old policy cast in same mould | | | Early Times Report
JAMMU, JANUARY 20: In what could be seen as re-implementation of an old transfer policy, the state government has decided to put a ban on mid-session transfers of teaching staff. The government claims that the decision has been taken to ensure availability of teachers in the schools, but the record of successive governments clearly shows that a similar policy used to be pursued during Farooq Abdullah’s regime, by the then Education Minister Mohammad Shafi and during Mufti Mohammad Sayeed’s regime by the then Minister for Education Harsh Dev Singh. As per the new transfer policy, the transfer of teaching personnel shall be made only at the beginning or at the end of academic session and no mid-session transfer shall take place. The minimum term of teaching personnel at a place shall be two years in plain areas and one year in hilly areas, while the maximum term of teaching staff at a place shall be 3 years. The Directors shall be competent to make transfers of Masters, Headmasters and Lectures within their respective jurisdiction except premature transfers whereas the Chief Education Officer shall make transfers of teachers and Masters within the District except premature transfers. There shall be no inter-district or inter province transfer in view of the provisions of SRO 343 of 2004 and circular instructions of General Administration Department, issued vide No. GAD (Adm) 315/2009-v Dated 23-11-2009. RET shall not be transferred even after regularization of their services as Teachers, as their appointment is school specific. Temporary transfer on medical grounds can be considered only in case a teacher or his/her spouse suffers from terminal illness like Cancer or Kidney failure etc to be certified as terminal illness by Special Medical Board Srinagar/ Jammu, already constituted for the purpose and such temporary transfers shall be reviewed after every six months. Transfers of teacher on security grounds can be considered temporarily for one year in the first instance if threat perception on the relevant date is certified by an officer not below the rank of the relevant date is certified by an officer not below the rank of ADGP (CID). Threat perception of such a teacher shall be got reviewed thereafter. Inter-zonal transfer of teaching personal shall not be effected before the completion of minimum prescribed tenure at a place by the teacher. Inter-zonal transfer of teaching personnel shall not be effected before the completion of the minimum prescribed tenure of a teacher in an education zone. No attachment of teaching personnel shall be allowed. Deployment of teaching personnel on need basis shall be allowed only in respect of newly upgraded middle and high schools to meet the deficiency of staff/subject specific teachers on the requisition of Head of Institution concerned.
