| Police driver sentenced to 1 yr imprisonment in accident case | | | EARLY TIMES REPORT Jammu, Jan 31- Chief Judicial Magistrate Jammu YP Bourney, in an accident case, sentenced police driver Manmohan Singh to year imprisonment besides imposing Rs, 5000 fine.
After hearing Chief Prosecuting Officer Pawan Khajuria appearing for the state and counsel for the accused and also going through the statement of witnesses, the CJM observed that from the evidence on record it is proved beyond any cluster of doubt that accused was driving the vehicle at a high speed at the night hours when it hit and run over a girl child as a result of which she died. The ingredients of offences punishable U/Ss 279/304-A RPC are clearly established and accused is convicted accordingly for the commission of aforesaid offences. As regards sentence accused is first offender having no criminal record as such he deserves certain amount of leniency. Taking into consideration the age and circumstances of the case the accused is sentenced to undergo imprisonment for a period of one year and fine of Rs 5000, the Court ordered.
According to prosecution case on March 2, 2005 accused Manmohan Singh driving a police gypsy rashly and negligently from Sainik School towards Nagrota Market caused accident near furniture shop as a result a girl aged seven years was hit and run over who died on spot. Police registered the FIR on the complaint of Constable Ravi Kumar and started investigation and after completion of the investigation challan was presented in the Court of law on August 22, 2005.
