| CJM awards 2 years imprisonment to matador driver | | |
Early Times Report Jammu, Feb 3 Chief Judicial Magistrate Jammu YPO Bourney today awarded two years imprisonment and fine of Rs five thousand to a Matador driver identified as Darvinder Kumar who is facing trial in a rash and negligent driving case, The accused driver had hit a scooter from behind as a result of which scooter rider as well as pillion sustained injuries. The pillion rider Ajay Kumar succumbed to injuries at Government Medical College & Hospital. The police after completion of the investigation filed challan under section 279/337/338 and 304-A of RPC on August 17, 1999 for judicial determination. While awarding sentence to driver, CJM Jammu YP Bourney after hearing Chief Prosecuting Officer Pawan Khajuria for the state and Adv Roop Lal appearing for the accused, observed that prosecution examined only 11 witnesses out of 16 cited in the charge-sheet, after going through the statement record of the prosecution witnesses, the prosecution has been successful in establishing that accused was driving the vehicle rashly and negligently as a result of which the scooter driver sustained grievous injuries whereas the pillion rider lost his life. The ingredients of offence punishable under section 279/337/338 and 304-A RPC are securely met, accused is therefore held guilty of these offence and convicted for the same accordingly. He is sentenced to undergo imprisonment for two years and fine of Rs 5000 for offence under section 304-A RPC. The accused, who was present in the court, sent to District Jail Jammu on the directions of CJM.
