Court rejects bail plea of ‘cheat’

The Court today dismissed the bail application of alleged cheat who was arrested by the police with 12 fake stamps and documents from Kalakote on January 21.
Special Excise Mobile Magistrate Jammu, Suneet Gupta rejected the bail application filed by Labhu Ram Seghal of Kalakote. Police had recovered the stamps recovered of SDM Nowhsera, Tehsildar Kalakote, Tehsil Supply Officer Kalakote, Casualty Medical Officer Kalakote, Special Correspondent CNN, Mohd Hanief KAS AC Revenue Rajouri, Sharma Medical Hall Kalakote and Madan Lal Sharma Member of Parliament from the possession of Labhu Ram.
Special Excise Mobile Magistrate Jammu Suneet Gupta after hearing Senior Prosecuting Officer Anil Dev Jamwal appeared for the State and Advocate Sachin Dogra appeared for the applicant, observed that recovery of 12 official stamps from the possession of the accused was itself sufficient to prove the guilt mind of the accused Labhu Ram and in addition it, the documents i.e. the socially backward class certificate and PRC Certificate recovered from his possession, itself pointed a figure of suspicion of guilt towards the accused Labdhu Ram that he was involved in preparing such like fake documents.
The investigation officer has recorded the statements of the concerned officers who had denied their signature and issuance of such certificates from their offices. From the perusal of the CD file, it also revealed that the accused Labhu Ram is habitual and professional offender and an FIR u/s 420/201 RPC was also registered at Police Station Kalakote and the charge-sheet has also been filed before the concerned court.
It was also alleged that the accused had received Rs 500 from a person for getting arms license transferred in his name.
Court while dismissing the bail application further observed that the accused Labhu Ram is in the habit of doing all such mischief and by keeping the official’s stamps of high officials and even the stamp of Member of Parliament, he can be expected to fabricate any document. This is a very alarming circumstances and such like person does not deserve the sympathy of Court to be bailed out.
Moreover, the investigation is still in infancy and may important facts are expected to be disclosed during investigation and if at this stage the accused be bail out, it is every likelihood that he shall be in a position to hamper the investigation.
