Jammu, Feb 5: Justice Virender Singh of J&K High Court Jammu Wing today ordered medical examination of Choudhary Nagar Singh, Choudhary Jagar Singh and Choudhary Rakesh Singh with the direction to Special Public Prosecutor that he shall submit medical report in the court on next date when the bail application is to be taken up for consideration.

K T S Tulsi a high profile Senior Advocate Supreme Court of India appeared along with Advocates R S Thakur and Maheen Pardhan for the Choudhary brothers submitted that he is not in a position to argue the bail application today as the entire challan is in Urdu and he has to get the same translated into English version for proper perusal of the same. Tulsi however stated at the Bar that all the petitioners who are presently in judicial custody are having certain ailments for which they need to be examined by a medical specialist. He further submitted that so far as Choudhary Nagar Singh is concerned, on the basis of certain documentary evidence attached with the bail petition, stated that Choudhary Nagar Singh has undergone a knee surgery about two years back and is having acute pain which has practically made him immobile. Besides this, he has some acute problems in spleen as well. He said that in September, 2008 Choudhary Nagar Singh had developed a cerebral problem which has caused some damage to his brain cells resulting into loss of consciousness. With regard to other two petitioners namely Choudhary Jagar Singh and Choudhary Rakesh Singh, there is no medical document placed on record. Upon this Court observed that there is however, no reason to disbelieve the statement made by Sr. Adv K T S Tulsi at the Bar with regard to the ailments of other two petitioners.
Sr. Adv Sunil Sethi Special Public Prosecutor representing the state stated that he has no objection at all if all the petitioners are examined by an expert doctor with regard to their respective ailments. He rather fairly stated that he would direct the Jail Supt/ Jail Doctor to make all necessary arrangements for transporting the petitioners to Government Medical College Hospital Jammu at the earliest. However Sr. Adv Sunil Sethi further submitted that it would not be practically possible for taking all the petitioners for their medical examination on one day and Choudhary Nagar Singh will be taken by Monday February 8, 2010 and other two petitioners thereafter will be examined positively by the end of next week on two different dates to be fixed by the doctor concerned.
Justice Virender Singh after hearing both the sides directed Sr. Adv Sunil Sethi that he shall submit the medical report before the Court on the next date when the bail application is to be taken-up for consideration on merits. Since Sr. Adv KTS Tulsi has to come from Delhi, he requested for some actual date for hearing the instant matter to which Sr. Adv Sunil Sethi has raised no objection and ordered that the bail application be listed on February 26, 2010 before the available bench having the roaster
