| HC asks DGP to file affidavit indicating ground of detention | | | EARLY TIMES REPORT JAMMU, Feb 12
Justice Sunil of J&K High Court Jammu Wing has directed the Director General of Police J&K to file an affidavit indicating the ground of detention of one Jamali Khan even though orders of revocation of his custody were passed on September 23, 2009. The much publicized Hawala money case, in which detenue Jamali Khan, an employee of the Mumbai Mercantile Cooperative Bank, who was associated with Hizbul Mujahideen and engaged by one GM Bhat, a Hawala money Courier. On the arrest of Jamali Khan, he was found carrying Rs 46, 89, 500 concealed in a CNG cylinder along with Logo of HM outfit while cash worth Rs 2.5 lacs, one walkman set and a mobile phone were recovered from his wife, she too was travelling with him in a Tata-Sumo Vehicle. He was detained under PSA, which was quashed later on. The petitioner, whose detention order has been quashed, has challenged the detention order dated July 31, 2009 passed by District Magistrate Udhampur. Additional Advocate General Jagdish Parihar has produced order dated September 23, 2009 indicating that detention order July 31, 2009 stands revoked. On the other hand Advocate RM Tufail appeared for the petitioner contested that despite revocation of the order, petitioner is in continuous detention. After hearing both the sides, Justice Sunil directed DGP that he shall file an affidavit indicating the ground of Jamali’s detention even after orders of revocation of his were detention were passed on September 23, 2009. Affidavit shall also disclose the place where the petitioner has been detained. Court further directed that affidavit be filed by or before February 17. (JNF)
