| Banquet Halls get temporary reprieve | | | Early times Report Jammu, February 16: Keeping in view coming marriage season, Division Bench of J&K High Court comprising Chief Justice Barin Ghosh and Justice Gh. Hasnain Masoodi today ordered that directions contained in the order of May 22, 2009 shall continue as they stand till further orders until June 1, 2010 whichever is earlier. Division Bench after hearing Adv Amrish Kapoor for the petitioners Puran Chand and others whereas AAG A H Qazi vice Advocate General appeared for the State, Sr. Adv Sunil Sethi, Sr. Adv MK Bhardwaj, Advocates Ajay Abrol, PN Raina, KS Johal, DS Chouhan appearing for the Banquet Halls whereas Advocate SS Nanda appeared for the Jammu Municipal Corporation. Division Bench while extending the order of May 22, 2009 observed that A H Qazi AAG submitted that Govt has not yet finalized the matter pertaining to Banquet Halls but it is in the process of finalizing the same. In that view of the matter, Division Bench ordered that the directions contained in the order May 22, 2009 shall continue, as they stand, until further orders or until June 1, 2010 whichever is earlier except that order of May 7, 2009 shall revive with full force with effect from June 1, 2010. DB clarified that the effect of this extension order shall apply to all Banquet Halls. On May 7, 2009 a Division Bench ordered that Banquet Halls which are running within Municipal Limits Jammu, without proper permission from the Municipal Corporation Jammu shall remain closed. On May 22, 2009 Division Bench comprising Chief Justice Barin Ghosh and Justice MH Attar recalled ordered dated May 7, 2009 whereby these Banquet Halls operating within the Municipal Limits had been ordered to be closed, modifying the last order, DB allowed these Banquet Halls to operate till December 31, 2009 and after expiry of said date, the earlier interim direction (closure of banquet halls) will automatically revived.
