CJM Granted bail to lady Corporator allegedly involved in illegal abortion case

Jammu, October, 11:- Chief Judicial Magistrate Jammu Mr. Sanjay Dhar granted interim bail to Rasheeda Begum JMC Corporator of Ward No 6 Gujjar Nagar Jammu, who is allegedly involved in illegal abortion case, which is registered with the Police Station Nowabad Jammu u/s 376/315 RPC.



As per the police report a complaint on August 23, 2006 was lodged in which it has been submitted that on November 27, 2005, the victim was raped by accused Subash Chander with result complainant victim become pregnant. The accused took the complainant in his confidence and assured that he will marry her in case, she get the child aborted. It has been alleged that accused with the help of some other persons took the complainant to one Dai namely Rasheeda Begum (Corporator) and got the child of the complainant aborted. The complainant thereafter approached the accused a number of times but the accused backed out from the promise of marriage. Upon this the complainant lodged this complaint with the police. During the investigation, the medical examination of the complainant has been conducted and accused Subash Chander was arrested, it was found that accused Subash Chander committed rape upon complainant which resulted in her pregnancy, Subash Chander with the aid of accused Rasheeda Begum got the unborn baby aborted.



While grating interim bail Mr. Sanjay Dhar CJM Jammu after hearing CPO for the State and Adv D S Chouhan appearing for the accused Corporator observed that the occurrence is alleged to have taken place in the month of November, 2005, whereas report has been lodged on August,2006, after nine months. So far as the role of applicant accused is concerned her role is only that she has helped the main accused in getting the un-born baby of the complainant aborted. There is nothing in the report to suggest that accused Rasheeda Begum (Corporator) did so against the consent of the complainant. The Custodial interrogation of the accused, who had surrendered before the court, in the opinion of the court is not needed. Accused as per the police report only her finger prints and photographs are needed to complete the investigation of the case. With these observations court granted interim bail to the accused Rasheeda Begum (Corporator) subject to furnishing bail bond with one surety bond in the amount of Rs 25,000/- each with the direction that accused shall appear before the IO as and when directed. She will surrender before this court on October 17, 2006.
