| Court convicted accused facing investigation and trail for last 26 years for misappropriating Rs 6300/- | | |
Jammu, October, 11:- Second Additional Sessions Judge Jammu Mr. AK Koul today convicted and sentenced Bodh Raj the then teacher/clerk Govt High School Gole-Gujral, who is facing investigating and trial in misappropriation of Rs 6300/-, the case was registered in the year of 1980 to undergo one and half year imprisonment and fine Rs 1000/-.
In the 27 pages judgment Mr. AK Koul Second Additional Sessions Judge Jammu after hearing Mr. Ravinder Sharma Additional Public Prosecutor appearing for the state and Advocate Rupak Ratta appearing for the accused observed that the accused without any authority after forging the signature of Drawing Officer and he as withdrawn an amount of Rs 3400/- and 2900/- from the treasury and never disbursed it to the persons in whose name amount was withdrawn, so he has committed an offence u/s 420/465/471 RPC and he is accordingly convicted.
Regarding the quantum of punishment to be imposed, Court further observed that it is pertinent to mention here that accused has been prosecuted in eight different cases and is facing the trail since last two decades. How much of trauma, embarrassment and agony, he must have faced during all this time is worth imagination. He has committed the crime and in view of all facts and circumstances, the Court feels that lesser punishment may even serve the cause of justice. Accused u/s 420 RPC sentenced imprisonment of six month and fine Rs 1000/- , 465 RPC he is also sentenced imprisonment for six months and u/s 471 RPC he is also sentenced to imprisonment for six months. Court ordered that sentences would run concurrently. The accused who was on bail, Court cancelled his bail and ordered that he shall be taken into custody to serve the sentence. |
