| Court rejects bail of rape accused | | |
EARLY TIMES REPORT JAMMU, Feb 17: The Court today dismissed the bail application of Bhawaneshwar Singh who tried to commit rape upon wife of his employer. As per the police report, on February 8, 2010, the complainant resident of Quarter number 1 Forest Complex Narwal moved an application before the Narwal police that at 10:30 a.m, the domestic help, Bhawaneshwar Singh locked the main gate of the quarter and tried to overpower the complainant to commit the rape, another servant Girdhari Lal who used to come around 10:00 a.m reached there and after finding the gate locked, he jumped over it and came inside and only then the complainant telephoned her husband (who is conservator of forest) who was in office. On this report, an FIR Under Section 376/511 RPC was registered and the statements of witnesses were recorded and accused was arrested. While dismissing the bail application, Special Mobile Magistrate Electricity Jammu R N Wattal after hearing Senior Prosecuting Officer Rajesh Bakshi appeared for the state observed that the attempt sexual assault has traumatized the prosecutrix/complainant, who is in a state of confusion and disbelief that someone she knew and trust would commit such an assault. She would be in state of shock, the attempt of sexual assault would definitely left emotional scare on the prosecutrix and obviously she cannot trust individuals and has trouble facing in social environment. With these observations Court dismissed the bail application. JNF
