| Driver sentenced to 3 yrs imprisonment | | | Kathua, Oct 12 Chief Judicial Magistrate Kathua Varinder Singh Bhou has convicted a driver for causing death due to rash and negligent driving and sentenced him to undergo simple imprisonment for three years. The accused Baldev Raj s/o Hans Raj R/o Chann Rorian, Hiranagar Distt Kathua has been convicted in offence u/s 304A RPC. For causing death, he was also directed to deposit Rs 1000 fine and in default of fine he shall undergo further simple imprisonment for 2 months, whereas for rash and negligent driving and causing injury he has been sentenced to simple imprisonment for one month and 500 rupees fine. Brief facts of the case are that on February 12, 1995 a matador no 6328/JK-02E being driven by accused Baldev Raj towards Chadwal rashaly, carelessly and in negligent manner on reaching near village Barwal at about 11.30 am hit a person namely Bhagwar Dass s/o Maan Lal r/o Dia Chak, Hiranagar Distt Kathua who received injuries and succumbed to his injuries. The matador was seized and FIR was register u/s 279, 337, 304 A RPC and investigation conducted. Chief prosecuting officer Ravinder Rao and prosecuting officer Ajay Sharma Advocate appeared on behalf of the state and argued that occurrence stands proved from the evidence of the eye-witnesses that accused while driving the matador rashly and negligently lost the control over vehicle and hit the deceased who died on the spot and other passenger received injuries. Involvement of the accused is fully proved, the court observed, adding the evidence on record is convincing and passes the test of reliability. |
